On St. Patrick’s Day ArrivalStar S.A. (Luxembourg) sued the MBTA (Boston, MA) for infringement of Patent Nos. 6,317,060 and 7,030,781 directed to monitoring vehicle location / delay. In a skillfully drafted section of the complaint, ArrivalStar asserts, in short declarative paragraphs, that the MBTA takes certain actions which correspond to specific claim limitations, e.g. “The MBTA system monitors the location of vehicles.” Such specific and limited statements of fact will be difficult for the MBTA to deny and will limit the dispute regarding infringement right off the bat.
ArrivalStar seeks a permanent injunction but does not assert that it is commercial entity who sells any products or services which compete with the MBTA.
