Norwood Yacht Sales, Inc. (Suffolk County, MA) has sued Lab Marine (Maryland) and Bank of the West (California)for copyright infringement and other claims resulting from a dispute over foreclosed property.
Norwood tried to sell a yacht over the internet in an ad that featured photographs taken by Norwood. Norwood was then contacted by Bank of the West (BOW) who said that it owned a security interest in the vessel and that it was planning on either foreclosing on or repossessing the vessel. It also told Norwood to continue to try to sell the vessel and also to maintain and preserve it during the sale period.
Norwood was unable to sell the vehicle so BOW told Norwood that its agent Lab Marine would try to sell it. Lab Marine was able to sell it, but in doing so it used Norwood’s photographs without permission. Norwood, upset at the unauthorized use of the photos (and probably also tweaked that Lab Marine was able to do what Norwood could not), filed suit.
