ASE Tech., Inc. (Wilmington, MA) has sued Nearstar, Inc. (Lewisville, TX) for declaratory judgment of non-infringement of a number of Nearstar copyrights.
In May 2009 Nearstar sued ASE in the E.D. Tex. for copyright infringement of a number of Nearstar’s computer programs. About a month later that court ordered the matter sent to arbitration. After the arbitration order ASE began developing a new software product. In the arbitration Nearstar accused this new product of infringing Nearstar’s “intellectual property.” ASE denies infringement but also denies that this claim is properly part of the arbitration. So ASE filed this DJ action.
