A set of Dunkin’ Donuts entities (Canton, MA) have sued a couple of donut shops in Billerica, MA and their owners for breach of their respective franchise agreements. The complaint alleges that the defendants conspired to defraud Dunkin’ of franchise fees, that Dunkin’ tried to terminate the franchises, and that defendants refused to shut down and continue to operate under the plaintiff’s name without authorization.
The complaint asserts a number of claims including breach of contract, fraud, and trademark and trade dress infringement. Dunkin’ seeks damages and an injunction terminating the defendants’ franchises.
