Polar Corp. (Worcester, MA) has sued PepsiCo (Purchase, NY) and one of Pepsi’s subsidiaries for trademark infringement. Polar alleges that Pepsi’s use of POLAR SHOCK for soft drinks and carbonated beverages infringes Polar’s trademark POLAR for the same goods. Pepsi has applied for federal registrations for its POLAR SHOCK marks; those applications have been opposed by Polar.
The verified complaint seeks damages as well as a preliminary and permanent injunction.
