Monotype Imaging, Inc. (Woburn, MA) has sued Deluxe Corp. (Shoreview, MN) for trademark infringement and related claims stemming from defendant’s use of font names that plaintiff alleges infringe its trademark rights in its own font names. Defendant sells checks and other printed materials to consumers. Its website offers the consumers a choice of fonts, including those owned by the plaintiff. The complaint alleges that while the defendant has a typsetting license to the fonts in question, the license only covers use by defendant’s employees at defendant’s premesis. Plaintiff alleges that by offering the fonts to customers over the web, defendant has engaged in unauthorized use. Seems like a stretch to me, but I haven’t seen the agreeement, which is not attached to the complaint due to confidentiality.
